By accessing or using the services provided by AM Media & Design ("Company", "we", "us", or "our"), including our website, client portal, and any related services, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you may not access or use our services.
AM Media & Design provides web design, web development, SEO optimization, custom backend solutions, and related digital services. The specific scope, deliverables, timeline, and pricing for each project will be outlined in a separate project proposal or service agreement provided to the client before work begins.
We provide a client portal where you can view invoices, make payments, and download project-related documents. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
Invoices are due by the date specified on each invoice. We accept payment via credit card, debit card, and other methods available through our payment processor, Stripe. All payments are processed securely through Stripe and are subject to Stripe's terms of service.
We offer three billing structures depending on the project:
Invoices not paid by the due date may be subject to a late fee. We reserve the right to suspend services for accounts with overdue balances until payment is received.
Payments processed through our client portal are handled by Stripe, a third-party payment processor. A service charge may be applied to invoices to cover the cost of payment processing fees incurred by Stripe. This charge is separate from the invoice total and will be clearly indicated at the time of payment. The service charge is non-refundable as it is passed directly to the payment processor. The exact amount of the service charge may vary depending on the payment method used (e.g. credit card, debit card).
Refund eligibility depends on the stage of the project and the type of service. Refund requests must be submitted in writing. Custom development work that has already been completed is generally non-refundable.
You retain ownership of all content you provide to us, including text, images, logos, and other materials. You grant us a license to use this content solely for the purpose of delivering our services.
Upon full payment, you will own the final deliverables (website design, code, and assets) created specifically for your project. We retain the right to showcase the completed work in our portfolio unless otherwise agreed in writing.
Any third-party assets used in your project (stock images, fonts, plugins) are subject to their respective licenses. We will inform you of any third-party assets and their licensing requirements.
Project timelines are estimates and may vary depending on project complexity, feedback turnaround time, and scope changes. Any changes to the original scope of work may affect the timeline and cost of the project. Scope changes will be documented and require mutual agreement before implementation.
We strive to deliver high-quality work, but our services are provided "as is" without warranties of any kind, either express or implied. We do not guarantee specific results such as search engine rankings, traffic increases, or revenue growth. We are not liable for any indirect, incidental, or consequential damages arising from the use of our services.
To the maximum extent permitted by law, AM Media & Design's total liability for any claim arising from or related to our services shall not exceed the total amount paid by you for the specific service giving rise to the claim.
Either party may terminate the service agreement with 30 days' written notice. Upon termination, you are responsible for payment of all work completed up to the termination date.
For recurring subscriptions (monthly or yearly), payments are collected automatically by Stripe on each renewal date using the payment method on file. Cancellation requests must be submitted in writing. Upon cancellation, your subscription will remain active until the end of the current billing period, after which no further charges will be made. No partial refunds are issued for unused time within a billing period.
Both parties agree to keep confidential any proprietary or sensitive information shared during the course of the project. This obligation survives the termination of the service agreement.
These terms shall be governed by and construed in accordance with the laws of the jurisdiction in which AM Media & Design operates, without regard to conflict of law provisions.
We reserve the right to update these terms at any time. Changes will be posted on this page with an updated "Last updated" date. Continued use of our services after changes constitutes acceptance of the revised terms.
